Resignation of Public Prosecutor General means independence
for the prosecution.
The Justice Minister, from the political circle, interfered with individual cases despite the fact that some may doubt if he had "a political intention." Public Prosecutor General Kim Jong-bin accepted the judicial authority of the Attorney General and resigned his position.
Public Prosecutor General Kim thought his resignation to be the best choice to protect the independence of the prosecution. He said, "It is really deplorable that the Attorney General didn't keep his neutral position, but tried to influence individual cases. He indicated that judicial authority mired the independence of the prosecution. Although independence of the prosecution is one of the best administrative records during President Noh Moo Hyun's regime, the Public Prosecutor General denied that.
They will wrap up the situation by the resignation of Public Prosecutor General. However, there remain a lot of problems concerning the neutral position of the prosecution.
The Blue House and the ruling party insist that the Justice Minister's exercise of judicial power is a judicial problem, which is not related to the neutral position of the prosecution.
In fact, independence of the prosecution is conceived to be a political and social priority through the judicial authority. The Korean Bar Association, from the law circles, has even said, "The prosecution is too damaged to recover its independence and justice." As the exercise of judicial power by the Justice Minister resulted in resignation of the Public Prosecutor General and damage of the prosecution, the Blue House and the ruling party should take some follow-up measures. They must modify the legal system to ensure independence of the prosecution.
The prosecution also should reflect on itself through this case. Independence of the prosecution is not for the organization. They must remember that independence of the prosecution is for social justice through checks and balances.
